Lempira Adventures Terms and Conditions

TRIP COSTS INCLUDE: The guide services of Lempira Adventures professionals. All tours and services in the destination country, hotel, boat and lodge accommodations, transfers, and ground transportation. Meals specifically listed in your itinerary. Accommodations and services listed in the trip itinerary are subject to change, but substitutions will be of similar or better quality.

NOT INCLUDED: Airfare to your destination. Passport fees, foreign exit taxes, beverages, laundry, telephone charges, excess baggage, gratuities, insurance, souvenirs, or any expense of a personal nature. Meals not listed as specifically included in the itinerary.

RESERVATION AND PAYMENT: Reservations will be accepted upon receipt of a $200 deposit fee per person, with a completed trip application. Final payment of balance due must be made not later than 30 days prior to departure date. If balance is not paid when due, Lempira Adventures reserves the right to treat the reservation as canceled with loss of deposit. If a particular trip has less than the minimum number of people booked to depart, those people booked will be given the option of tier pricing, transferring their payments to another trip or canceling at no penalty to them.

CANCELLATION POLICY: If you wish to cancel your trip, for any reason, you must notify Lempira Adventures by phone and in writing. If you cancel 30 days or more prior to departure, you will receive a full refund, less a minimum $50 administrative cost fee. Cancellation 29 days and less prior to departure will receive as a refund, only those moneys we can recover from our suppliers and outfitters, less the $50 administrative fee. NOTE: We seldom receive any refunds from our suppliers after the 30 day pre-departure point. Assume that if you cancel under 30 days, you will not receive any refund. PURCHASE TRAVELERS INSURANCE if you are concerned about this possibility. Unused tour features are neither refundable nor exchangeable once the tour is in progress.

REQUIREMENTS: Participants should be in good physical condition as well as arrive with an attitude of flexibility and willingness to be part of a team.

RESPONSIBILITY AND LIABILITY:
(a) Participation in the tour and related activities is at each participant's sole risk. It is each participant’s responsibility to decide whether or not he or she wants to and is able to participate in any given activity.
(b) Lempira Adventures, its affiliates, and its employees, associates, officers, investors, agents, and representatives shall not be liable for any loss, damage, injury or cost whatsoever, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages, caused directly or indirectly by, or as a result of the tour or related activities or inability to use the tours or any related activities, to any participant, third party and/or property. All such losses, damages, injuries or costs shall be the sole responsibility of the affected participant(s).
(c) Lempira Adventures tours are provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.
(d) The above disclaimers of liability apply to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action.
(e) The information, software, products and services published on www.lempiraadventures.com website may include inaccuracies. In particular, Lempira Adventures does not guarantee the accuracy of, and disclaims all liability for inaccuracies relating to the information and description of the hotels, activities, restaurants and other travel products displayed on said website. Lempira Adventures may make changes to said website at any time.
(f) Each Participant specifically acknowledges that Lempira Adventures is not liable for the defamatory, offensive or illegal conduct of other users or third parties and that the risk of injury from the foregoing rests entirely with the participant.
(g) The right to alter any tour arrangement is reserved by Lempira Adventures. All rates and schedules are subject to change without notice. Any unused portion of package is non-refundable after commencement of tour.
